1.2 Who May Use the Platform

The Platform is intended for:

  • Educational institutions (schools, universities, learning centers)
  • School administrators and staff
  • Licensed educators and teachers
  • Students enrolled through educational institutions
  • Authorized institutional users

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Updating the “Last Updated” date
  • Posting a prominent notice on the Platform
  • Sending email notification to registered users

Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

2.3 Service Availability

  • The Platform is provided on an “as available” basis
  • We strive for 99% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We reserve the right to modify, suspend, or discontinue any feature

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account by providing:

  • Accurate and complete information
  • A valid email address
  • A secure password
  • School or institutional affiliation (where applicable)

3.2 Account Types

School Administrator Accounts:

  • Manage school-wide settings and users
  • Oversee educators and students
  • Access school-level analytics
  • Manage subscription and billing

Educator Accounts:

  • Create and manage classes
  • Book VR experiences for students
  • Access student progress data
  • Assign educational content

Student Accounts:

  • Access assigned VR experiences
  • Participate in scheduled sessions
  • Complete assessments and quizzes
  • View personal learning progress

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and changing them regularly

3.4 Account Termination

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse or misuse the Platform
  • Remain inactive for extended periods (2+ years)

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use the Platform only for lawful educational purposes and to:

  • Comply with all applicable laws and regulations
  • Respect the intellectual property rights of others
  • Use the service in accordance with institutional policies
  • Maintain appropriate professional conduct

4.2 Prohibited Activities

You may NOT:

  • Use the Platform for any illegal purposes
  • Harass, abuse, or harm other users
  • Upload malicious code or viruses
  • Attempt to gain unauthorized access to systems
  • Reverse engineer or decompile the Platform
  • Scrape or copy content without permission
  • Share account credentials with unauthorized persons
  • Use bots or automated systems without authorization
  • Interfere with Platform operations or security
  • Impersonate others or misrepresent your identity
  • Collect user data without consent

4.3 Content Standards

All user-generated content must:

  • Be appropriate for educational settings
  • Not contain offensive or inappropriate material
  • Respect copyright and intellectual property
  • Comply with school policies and codes of conduct
  • Be accurate and not misleading

4.4 Consequences of Violations

Violations may result in:

  • Warning notifications
  • Temporary suspension of access
  • Permanent account termination
  • Reporting to educational institutions
  • Legal action where appropriate

5. Booking and Scheduling

5.1 VR Experience Bookings

Booking Requirements:

  • Minimum 25 students per session
  • Maximum capacity varies by experience (typically 30 students)
  • Advance booking required
  • Valid class enrollment

Booking Process:

  • Educators select VR experiences from the catalog
  • Choose date and time for session
  • Select participating class
  • Specify expected student count
  • Receive booking confirmation

5.2 Pricing and Fees

Standard Pricing:

  • R20.00 per student per VR experience
  • Pricing is fixed regardless of session duration
  • No hidden fees or surcharges
  • Educational discount pricing available for bulk bookings

Payment Terms:

  • Payment may be required before session access
  • Institutional billing available for registered schools
  • Invoice payment terms: Net 30 days
  • Late payment may result in service suspension

5.3 Cancellation and Rescheduling

Cancellation Policy:

  • Cancellations must be made at least 48 hours in advance
  • Cancellations within 48 hours may incur fees
  • No-shows may be charged the full amount
  • Emergency cancellations considered on case-by-case basis

Rescheduling:

  • Free rescheduling if done 48+ hours in advance
  • Subject to availability
  • Same pricing applies to rescheduled sessions

5.4 Session Attendance

  • Students must join sessions using provided session codes
  • Educators are responsible for student supervision
  • Session duration is typically 30-60 minutes
  • Technical support available during sessions

6. Intellectual Property Rights

6.1 Platform Ownership

All rights, title, and interest in the Platform, including:

  • Software code and applications
  • VR experiences and content
  • Graphics, designs, and user interfaces
  • Trademarks, logos, and branding
  • Educational materials and curriculum

are owned by SemVR or our licensors and protected by:

  • Copyright laws
  • Trademark laws
  • Patent laws
  • Trade secret laws
  • International intellectual property treaties

6.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Platform for educational purposes
  • View and interact with VR experiences
  • Use educational materials in your teaching
  • Download materials explicitly marked as downloadable

You may NOT:

  • Copy, modify, or distribute Platform content
  • Create derivative works
  • Remove copyright or proprietary notices
  • Use content for commercial purposes
  • License or sell access to the Platform

6.3 User-Generated Content

Content You Create:

  • Class descriptions and materials
  • Student notes and annotations
  • Assessment responses
  • Comments and feedback

License to SemVR: By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store and display your content
  • Process content for service delivery
  • Generate analytics and insights
  • Improve our services

Your Responsibilities:

  • You retain ownership of your content
  • You must have rights to upload content
  • You warrant content doesn’t infringe others’ rights
  • You can delete your content at any time

6.4 Educational Fair Use

Educators may use Platform materials for:

  • Classroom instruction
  • Educational presentations
  • Non-commercial research
  • Curriculum development

7. Privacy and Data Protection

7.4 Student Data

School Responsibilities:

  • Schools are data controllers for student data
  • Schools must obtain necessary parental consents
  • Schools determine educational purposes for data use

SemVR Responsibilities:

  • We act as data processor for schools
  • We implement appropriate security measures
  • We do not sell student data
  • We limit data use to educational purposes

7.5 Data Security

We implement:

  • Bcrypt password hashing
  • HTTPS/TLS encryption
  • JWT authentication with 24-hour expiration
  • Regular security audits
  • Access controls and monitoring

8. Subscriptions and Payment

8.1 Subscription Plans

Available Plans:

  • Free Plan: Limited access, demo features, trial experiences
  • Basic Plan: Standard school access, limited sessions per month
  • Premium Plan: Enhanced features, unlimited sessions, priority support
  • Enterprise Plan: Custom solutions, dedicated support, API access

8.2 Billing and Charges

Billing Cycles:

  • Monthly subscriptions billed on signup date each month
  • Annual subscriptions billed once per year (discounted rate)
  • Per-session billing for pay-as-you-go

Payment Methods:

  • Credit/debit cards
  • Institutional purchase orders
  • Electronic fund transfer (EFT)
  • Invoice billing (approved accounts)

8.3 Price Changes

  • We may change pricing with 30 days’ notice
  • Current subscriptions maintain pricing until renewal
  • New pricing applies to renewals and new subscriptions

8.4 Refund Policy

Refunds Available For:

  • Technical issues preventing service access (pro-rated refund)
  • Billing errors or duplicate charges (full refund)
  • Cancellation within 7 days of initial signup (full refund)

Non-Refundable:

  • Completed VR sessions
  • Partial month subscriptions
  • Cancelled sessions without proper notice

8.5 Late Payment and Suspension

  • Accounts with payments 30+ days overdue may be suspended
  • Access will be restored upon payment
  • Accounts 90+ days overdue may be terminated
  • Re-activation fees may apply

9. Technical Requirements

9.1 Hardware Requirements

Recommended for Educators/Administrators:

  • Modern computer (Windows 10+, macOS 10.14+, Linux)
  • Minimum 4GB RAM (8GB recommended)
  • Modern web browser (Chrome, Firefox, Safari, Edge)
  • Stable internet connection (10 Mbps minimum)

For VR Experiences:

  • VR headset (Oculus Quest, HTC Vive, or compatible)
  • Room-scale play area (2m x 2m minimum)
  • VR-ready graphics card (if PC-tethered)

For Mobile Access:

  • iOS 13+ or Android 8+
  • Modern mobile browser
  • WiFi or 4G/5G connection

9.2 Browser Compatibility

Supported browsers:

  • Google Chrome 90+
  • Mozilla Firefox 88+
  • Safari 14+
  • Microsoft Edge 90+

Unsupported:

  • Internet Explorer (all versions)
  • Outdated browser versions
  • Browsers with JavaScript disabled

9.3 Internet Requirements

  • Minimum 10 Mbps download speed
  • Low latency (< 100ms recommended)
  • Stable connection required during VR sessions
  • Public WiFi may not provide adequate performance

  • Warranties of merchantability

  • Non-infringement
  • Accuracy or completeness of content
  • Uninterrupted or error-free operation

10.2 Educational Outcomes

We do not guarantee:

  • Specific educational outcomes or improvements
  • Student performance gains
  • Learning results or achievements
  • Suitability for specific curricula

10.3 Technical Performance

We do not warrant:

  • Compatibility with all devices or systems
  • Uninterrupted or error-free service
  • Complete accuracy of analytics
  • Availability during maintenance or outages

10.4 Third-Party Content

  • We are not responsible for third-party content or links
  • External links are provided for convenience only
  • We do not endorse third-party products or services

10.5 User Responsibility

You acknowledge that:

  • You use the Platform at your own risk
  • You are responsible for device and internet costs

  • You are responsible for supervising students

11. Limitation of Liability

11.1 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEMVR SHALL NOT BE LIABLE FOR:

Indirect Damages:

  • Loss of profits or revenue
  • Loss of data or information
  • Loss of business opportunities
  • Reputational harm
  • Consequential or incidental damages

Direct Damages:

  • Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
  • For free accounts, liability is limited to R1,000

11.2 Exceptions

Some jurisdictions do not allow limitation of liability for:

  • Personal injury
  • Fraud or intentional misconduct
  • Gross negligence
  • Violations of consumer protection laws

Where applicable, these limitations may not apply to you.

11.3 User Indemnification

You agree to indemnify and hold harmless SemVR, its officers, directors, employees, and agents from:

  • Your violation of these Terms
  • Your violation of others’ rights
  • Your content or conduct

12. Term and Termination

12.1 Term

These Terms remain in effect while you use the Platform.

12.2 Termination by You

You may terminate your account at any time by:

Effect of Termination:

  • Access to Platform will cease
  • Data may be retained as required by law
  • No refunds for prepaid services (unless stated otherwise)

12.3 Termination by SemVR

We may terminate or suspend your account:

  • For non-payment (after notice period)
  • For illegal activities
  • At our discretion with 30 days’ notice

12.4 Effect of Termination

Upon termination:

  • All licenses granted to you terminate
  • You must cease using the Platform
  • You may request data export (within 30 days)
  • Sections that survive termination remain in effect

13. Dispute Resolution

13.1 Informal Resolution

You agree to bring claims only in your individual capacity and not:

14. School and Institutional Provisions

Schools and institutions agree to:

  • Obtain necessary parental consents
  • Maintain appropriate supervision

14.2 Educator Responsibilities

Educators agree to:

  • Use Platform for authorized educational purposes
  • Supervise students during VR sessions
  • Ensure age-appropriate content selection
  • Report technical issues or concerns
  • Maintain professional conduct

14.3 Student Safety

Schools are responsible for:

  • Ensuring VR safety protocols
  • Providing adequate physical space
  • Monitoring for VR-related health issues (motion sickness, eye strain)
  • Following manufacturer safety guidelines
  • Obtaining medical clearances if necessary

14.4 Data Processing Agreement

Schools may request a formal Data Processing Agreement (DPA) that specifies:

  • Roles as data controller and processor
  • Data security measures
  • Breach notification procedures
  • Sub-processor arrangements
  • Data retention and deletion

15. Accessibility and Accommodations

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SemVR regarding the Platform.

  • To the extent permitted by law

17.3 Waiver

Failure to enforce any provision does not constitute a waiver of:

  • Do not include support services
  • Should not contain real student data

18.2 Demo Account Use

Demo accounts are intended for:

Not permitted:

  • Commercial use
  • Real student instruction
  • Production workloads

19. Health and Safety Warnings

19.1 VR Health and Safety

Before Using VR Experiences:

Consult a physician if you:

  • Have pre-existing medical conditions (heart, vision, psychiatric)
  • Have a history of seizures or epilepsy
  • Are taking medications that affect perception

VR Use May Cause:

  • Eye strain or fatigue
  • Motion sickness or nausea
  • Disorientation or dizziness
  • Headaches
  • Loss of balance or awareness

Safety Recommendations:

  • Take breaks every 30 minutes
  • Ensure clear play area free of obstacles
  • Remain seated if experiencing discomfort
  • Stop immediately if symptoms occur
  • Supervise young users at all times

19.2 Age Restrictions

  • Minimum age: 13 years (in accordance with VR manufacturer guidelines)
  • Users under 18 require parental consent
  • Schools should follow manufacturer age recommendations
  • VR use should be limited for young users

19.3 Ergonomics

  • Ensure proper headset fit
  • Adjust headset straps for comfort
  • Maintain good posture
  • Adequate lighting in physical environment
  • Regular breaks to prevent fatigue

19.4 Disclaimer

YOU ASSUME ALL RISKS ASSOCIATED WITH VR USE. SEMVR IS NOT RESPONSIBLE FOR INJURIES OR HEALTH ISSUES RESULTING FROM VR EXPERIENCES.
